Is Your Home in Violation?

We continue to educate and inform our homeowner, their tenants, management companies and service providers of the Indian Point Deed Restrictions and Osceola County Ordinances that govern our community.  As our attorney notified all homeowners earlier this year, whether or not you are current with your Indian Point Homeowners Association membership dues, you are legally required to comply with the Covenants, Conditions and Restrictions of the Indian Point Community.  As per Florida State Statute, homeowners can be assessed for violation of these rules will result in assessment of a violation and fines, starting at $100.00 per day, per violation.  Further legally action can result and liens placed on the property, all at the homeowners expense, normally starting at $2,500.00.  All violations incurred by the tenant and property management are the homeowners responsibility.  So please make sure if you rent your home, you inform your tenants and employees of their required compliance.  Assessment of violations can also result in the suspension of members priviledges including the use of the Recreational Complex.
 
Code Enforcement posts a notice at the property with the homeowner, tenant, management company or service provider.  A copy will be sent to the owner of the property at the address listed on the Osceola County Property Appraisers records.  The address of the violation will also be posted on our website.  Homeowners are asked to check the website regularly for updates on violations.  A date to correct the violation will be given with the first notice of violation.  If on reinspection, the violation continues a second notice will be given.  At this time, if the violation is not corrected, further action will be taken.  A appearance before the Osceola County Code Board can result in assessment of fines starting at $250.00 per day.  So, please remind your management companies, service providers and tenants of the rules and to comply, so you the homeowner are not fined.
 
Further per Osceola County Ordinance 95-10, all homeowners who rent their home, whether short or long term are legally required to have an Osceola County issued Business License.  The Osceola County Tax Office issues these licenses and sends out renewals which are payable by September 30th.  If you have any questions you can contact them at (407) 742-4000.  Osceola County Code Enforcement and the Tax Office do check through out the community to see that all homeowners are within compliance.  Please be within the legal guidelines as not to be assessed a violation and fines starting at $250.00 per day.  You can also check to see if your home was cited by Osceola County by checking their website at velocityhall.com.
 
At the request of our homeowners, in order to assist our resident and non-residents homeowners, if there home is in violation of the Indian Point Deed Restrictions and Osceola County Ordinances, we instituted the procedures to communicate the violations to them via our website.  Please check back frequently as violations are updated.
 
Please comply as not to be assessed a violation and fine!

Below are the homes in current violation of the Indian Point Covenants, Conditions and Restrictions, also know as the Deed Restrictions and the Osceola County Ordinances that govern our community.  We realize that not all homeowners reside within the community, so as a service to our homeowners at their request, we will list here those homes that are in violation.  Further action will be taken if the violation is not corrected, including assessment of fines and legal action, all at the homeowners expense.  It is the homeowners responsibility to insure that their tenants and property manger are incompliance of all rules.  Please correct the violation so you are not subjected to further action.

There were also homes cited for violations by Osceola County Code Enforcement for trash and debris, and lawn maintenance.  Plus, homeowners were cited for not having their business license to rent out their home and not having the required properly displayed house numbers.  These rules are Florida State Statute and Osceola County Ordinance.
